By subscribing to our BOC-3 service you automatically agree to the following terms and conditions:

How the Process Agent Service Works:
Government Filings LLC is the blanket company which acts as a messenger of legal documentation received for our FMCSA subscribers only. We agree to accept legal documentation (regarding transportation related cases only) as prescribed in the Code of Federal Regulations Part 1044. Government Filings LLC will then forward the documentation on to you, our subscriber, in a timely manner either by fax, email and/or mail.

All summons received on your behalf will be mailed to you via Priority Mail with Signature Confirmation to the address listed on the FMCSA/USDOT systems. It is your responsibility to be sure the FMCSA/USDOT systems reflect the most up to date contact information such as mailing address and phone numbers.

We will not accept any divorce papers or any other personal court documents that is not related to the interstate transportation industry.

Scope of Services:
Government Filings LLC only accepts Service of Process in its role as a BOC-3 service provider. Government Filings LLC has designated agents for this purpose in all fifty (50) states. Government Filings LLC designated agents cannot be used by its clients for their own purposes. For instance, clients are not authorized to designate Government Filings LLC agent in the client’s base state as their corporate Registered Agent for Service of Process with the base state’s Secretary of State. Government Filings LLC’s role is strictly limited to accepting legal documents as the BOC-3 Filing Service Provider only, and for no other purpose. Government Filings LLC does not assist motor carriers and/or any other transportation related company with designating registered corporate agents or any agents beyond the scope of BOC-3 services.

BOC-3 Filing Expiration:
The BOC-3 Filing does not expire according to the FMCSA. It will remain on your account until you initiate a name change and/or reinstatement. If this happens then the BOC-3 Filing will drop from your account and it will need to be re-filed. Visit http://www.governmentfilingsllc.net to submit a new order for a BOC-3 Filing or call the office at 843.992.8869 if this occurs. It may be removed by Government Filings LLC by the notice in Termination of Service [see below]. Please be advised removal of the BOC-3 Filing may result in loss of your authority.

Payment:
All payments for process agent services are due upon receipt. If a payment is not received or payment method is declined, your request for BOC-3 filing will not be granted. If you initiate a credit card dispute it will be removed immediately which may result in inactivation of your authority from the FMCSA.

Annual Fees:
We reserve the right to charge an annual fee of $125.00 for process agent services. The BOC-3 Filing runs from January 1st through December 31 of each calendar year. Renewal payments are due no later than January 1 of the following calendar year to avoid interruption of the Filing.

Filing Policies:
All BOC-3 Filings are final. Once the BOC-3 is electronically filed with the FMCSA it cannot be reversed. The FMCSA does not allow BOC-3 Filings to be dropped from their system by a third-party company. Only the FMCSA can reverse a BOC-3 Filing and that is at their discretion. If the BOC-3 Filing is dropped by the FMCSA, it can then be replaced by a new BOC-3 Filing.

Refund Policy:
All BOC-3 sales are final.

Cancellation:
A BOC-3 order may not be cancelled as it is electronically filed as soon as the payment is received and cannot be reversed.

Indemnification:
You agree to indemnify, defend and hold harmless Government Filings LLC, its affiliates, successors, joint ventures’, partners, officers, directors, employees, agents, licensors, suppliers and any third party information and/or service providers to the Service from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of this Agreement (including but not limited to negligent or wrongful conduct) by you or any other person accessing the service.

We do not provide any legal advice. You will need to seek appropriate legal representation on your own, if applicable.

Termination of Service:
Government Filings LLC reserves the right to cancel & remove the BOC from the FMCSA record under these circumstances:
• Disputed credit card charge
• Non-payment of annual fee [only if served]
• At the discretion of Government Filings LLC in unusual circumstances outside of normal business practice
